The past 13th of April the promulgation of law RD 235 / 2013 has been published by the Ministry of the president to settle the procedure of the ENERGIE CERTIFICATION OF BUILDINGS.

This new law substitutes the former law RD 47/2007 which only considered dwellings in new construction.

This new law is obligation since 14th of April 2013, to be applied for ALL HOUSES OR DWELLINGS which are offered for RENTAL or for SALE from 1st of June 2013.

The Ministry makes available the rules of procedure for the release of the certification of the energetic efficiency which will be used by our architects.

Why?

The new law seeks to adhere to the european guidelines 2010/31/EU which are striving to the self-sufficiency energy wise in 2020 (green housing).

And that´s why it is so important to start to really know what the energy consumption is and what can be done to approach a better result.

Who is required to obtain a certificate?

Everyone who owns an apartment or a family house or a dwelling has to apply for a certification of the energetic efficiency.

What is the certification of the energetic efficiency?

It is a written certification which determines from A to G the efficiency of the energetic consumption in your apartment, your house, your dwelling, your retail shop….. Analysing the materials of construction, heating system, water-heating system, considering also orientation, sunlight…

It is valid for 10 years and has to be elaborated by an architect  who qualifies for it.

Consequences !

The notary is obliged to enclose the certification of the energetic efficiency with the sales contract and later it will be send to the register.

Real Estate Agents are obliged to publish the energy rating of in all publications.

The catalogue of fines establishes fines from 300 to 6.000 Euro if someone is not in possession of the certification.
